This Risk Disclaimer forms part of your agreement with LYTICK Technologies Limited. By accessing or using any part of the LYTICK platform, you confirm that you have read, understood, and agreed to the terms set out below. If you do not agree with any part of this disclaimer, do not use LYTICK.

PLAIN ENGLISH SUMMARY LYTICK

is a chart analysis and simulation tool not a financial advisor. Trading is risky. You can lose money. LYTICK does not change that. Replay results do not predict real trading outcomes. You are solely responsible for every trading decision you make. LYTICK is not affiliated with or endorsed by Deriv or any broker.

1. Nature of the LYTICK Platform

LYTICK is a technology platform providing charting, market analysis, and chart replay simulation tools for users of Deriv financial instruments, including Synthetic Indices, and other markets. LYTICK is a software product operated by LYTICK Technologies Limited, a private company incorporated under the laws of the Federal Republic of Nigeria (RC-9384204).

What LYTICK is:

  • A visual chart analysis environment for studying past and live market data.
  • A chart replay and simulation tool for testing analysis strategies against historical data.
  • A drawing and indicator tool for marking, studying, and planning market setups.
  • A personal productivity tool for traders seeking to improve their analytical skills.

What LYTICK is not:

  • A licensed financial advisor, investment advisor, or financial planner.
  • A licensed broker, dealer, or regulated financial services provider.
  • A trading signal service or market prediction system.
  • A guarantee of any trading outcome, profit, or return.
  • An affiliate, subsidiary, or partner of Deriv or any other broker. LYTICK uses Deriv's public API under Deriv's published developer terms as an independent third-party application.

2. No Financial Advice

Nothing on LYTICK including charts, indicators, drawings, replay sessions, AI-generated observations, community discussions, or any other content generated by or displayed through the platform constitutes financial advice, investment advice, a recommendation to buy or sell any financial instrument, or an invitation to trade.

You must not interpret any feature of LYTICK as a signal, recommendation, or endorsement of any specific trade, strategy, instrument, or position. All analysis performed using LYTICK is your own analysis, made by you, for your own purposes.

If you require financial advice, you should consult a qualified and licensed financial advisor in your jurisdiction.

3. The Risk of Trading Financial Instruments

TRADING INVOLVES SUBSTANTIAL RISK OF LOSS

The following risk disclosures are not marketing language. They describe real financial risks that affect real traders. Read them carefully before using LYTICK to inform any trading decision.

General Market Risk

Trading financial instruments including Deriv Synthetic Indices, forex pairs, commodities, indices, and any other instruments accessible through the Deriv platform involves a significant risk of financial loss. Markets can move against your position rapidly and without warning. You may lose some or all of your invested capital.

Synthetic Indices Specific Risk

Deriv Synthetic Indices are simulated markets generated by Deriv's proprietary algorithm. They operate 24 hours a day, 7 days a week, including weekends and public holidays. They are not influenced by real-world economic events, but they exhibit volatility, price gaps, and unexpected movement that can result in rapid and total loss of any capital placed in a trade. Past behaviour of any Synthetic Index is not predictive of future behaviour.

Leverage and Multiplier Risk

Many Deriv instruments including CFDs and multiplier contracts involve leverage, meaning your exposure to gain or loss is a multiple of your initial stake. Leveraged trading amplifies both profits and losses. A small adverse market movement can result in losses that significantly exceed your initial investment. You should not trade leveraged or multiplier products unless you fully understand how they work and can afford to absorb losses.

Psychological and Behavioural Risk

LYTICK's replay and simulation environment is designed to support disciplined analysis. However, performance achieved in a replay environment where market data is historical and outcomes are fixed does not reflect the psychological pressures, execution uncertainty, latency, and slippage present in live trading. A strategy that appears to work in replay may perform differently when executed with real capital under live market conditions.

4. Chart Replay and Simulation Specific Disclaimer

LYTICK's chart replay feature allows users to step through historical market data candle by candle, with the option to set prediction markers and observe how their analysis compares to historical price movement. This feature is provided strictly as an educational and analytical tool.

Replay sessions use historical data retrieved from Deriv's API at the time of the session. Data accuracy depends on Deriv's API availability and data integrity, which LYTICK does not control.

Results observed during a replay session including whether a prediction marker was hit, whether a zone held, or whether a setup played out reflect what happened historically at that specific moment. They do not predict, guarantee, or suggest any probability of future market behaviour.

LYTICK's AI Analyst feature, where available, generates observations about patterns noted during a replay session. These observations are algorithmic, descriptive, and retrospective. They are not forward-looking, and they do not constitute a trading recommendation or signal.

No replay session result should be used as the basis for placing a real trade without independent analysis, risk assessment, and consideration of current live market conditions.

5. Data, Technology, and Platform Risk

LYTICK relies on the Deriv WebSocket API for real-time and historical market data. LYTICK Technologies Limited does not own, control, or guarantee the accuracy, continuity, or availability of this data.

Data interruptions, API outages, or changes to Deriv's API terms may affect LYTICK's functionality at any time without advance notice.

LYTICK is a browser-based application. Platform performance is subject to the user's device capability, browser version, and internet connection quality.

Session data stored via IndexedDB is stored locally on the user's own device. LYTICK Technologies Limited does not guarantee recovery of locally stored data in the event of browser data deletion, device failure, or application error.

LYTICK does not execute trades on your behalf and does not have access to your Deriv trading account unless you explicitly authorise access through Deriv's OAuth system for the purpose of Pro account verification.

6. No Guarantee of Outcome or Platform Availability

LYTICK Technologies Limited makes no warranty, express or implied, that:

  • Use of LYTICK will improve your trading performance, consistency, or profitability.
  • Any analysis, setup, or strategy identified or tested using LYTICK will result in profitable trading outcomes.
  • The LYTICK platform will be available without interruption, error, or data loss.
  • Information displayed on LYTICK is accurate, complete, or up to date at any given moment.

The platform is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by applicable law, LYTICK Technologies Limited disclaims all warranties of any kind in connection with the platform and its content.

7. Limitation of Liability

To the maximum extent permitted by the laws of the Federal Republic of Nigeria and any other applicable jurisdiction, LYTICK Technologies Limited, its directors, officers, employees, and agents shall not be liable for:

  • Any direct, indirect, incidental, consequential, or special damages arising from your use of LYTICK or inability to use LYTICK.
  • Any trading losses, financial losses, or investment losses, whether or not LYTICK was used in connection with the trading decision that led to those losses.
  • Any loss of data, loss of access to analysis or drawings, or loss of session history.
  • Any decisions made in reliance on charts, indicators, replay results, AI observations, or any other content generated by or displayed through LYTICK.

Where liability cannot be fully excluded by law, the total aggregate liability of LYTICK Technologies Limited to any user arising out of or in connection with the platform shall not exceed the total subscription fees paid by that user to LYTICK in the three-month period immediately preceding the event giving rise to the claim, or NGN 10,000, whichever is greater.

8. Your Responsibility as a User

By using LYTICK, you confirm and agree that:

  • You are at least 18 years of age and legally capable of entering into binding agreements in your jurisdiction.
  • You understand that trading financial instruments involves risk of loss and you accept that risk fully and independently.

You are solely responsible for all trading decisions you make, regardless of any analysis, chart, drawing, replay result, or observation you viewed on LYTICK before making that decision.

You will not use LYTICK as a substitute for independent financial advice where such advice is required or advisable for your situation.

You have reviewed and understood Deriv's own terms, conditions, and risk disclosures applicable to your trading account and the instruments you trade.

You will comply with all applicable laws and regulations in your jurisdiction relating to trading, investment, and use of online financial tools.

9. Jurisdiction and Regulatory Status

LYTICK Technologies Limited is incorporated in the Federal Republic of Nigeria and operates under Nigerian law. LYTICK is not registered as a financial services provider, investment advisor, broker, or regulated entity in Nigeria, the United Kingdom, the European Union, or any other jurisdiction. LYTICK does not hold a licence from the Securities and Exchange Commission (SEC) Nigeria, the Financial Conduct Authority (FCA), the Central Bank of Nigeria (CBN), or any equivalent regulatory body.

This disclaimer does not limit or exclude any rights you may have under the mandatory laws of your jurisdiction that cannot be contractually excluded.

10. Updates to This Disclaimer

LYTICK Technologies Limited may update this Risk Disclaimer at any time. Changes will be posted at lytick.com/risk-disclaimer with a revised effective date. Continued use of LYTICK after any update constitutes acceptance of the revised terms. If a change is material, we will notify users via the platform or by email where an address has been provided.
